EPR fees are not a flat tax on packaging. They are a structured cost that varies by material type, by weight, and — in states with eco-modulation systems — by the recyclability of the packaging itself. The packaging decisions your product and procurement teams make today are already determining what your compliance costs will be in active fee states. They are being made, in most cases, without that calculation in the room.
This guide explains how EPR fee structures work, what eco-modulation adds on top of base rates, and why the financial implications of packaging material choices require attention from functions that have not historically been involved in EPR compliance.
The most common misconception about EPR fees is that they function like a single rate applied to total packaging weight — a simple number that compliance can look up and finance can budget. That is not how the fee structure works in any active U.S. state.
EPR fees are calculated at the material category level. Each packaging format — corrugated cardboard, PET thermoform, HDPE rigid, glass, aluminum, flexible film, multi-layer laminate — carries its own rate per pound. The same 100,000 pounds of covered packaging, structured differently across material categories, produces materially different fee outcomes. A producer with a heavy flexible laminate or multilayer pouch component faces a fundamentally different fee exposure than a producer whose packaging composition is predominantly corrugated and glass, even at identical weight.
In Oregon, which began collecting fees in 2024 and publishes its rate structure publicly, the spread between the lowest- and highest-fee material categories spans an order of magnitude. Producers using high-cost packaging categories pay significantly more per pound than producers in lower-cost categories — not because they produce more packaging, but because of what their packaging is made of.
As fee-active states expand and fee rates increase over program cycles, packaging architecture increasingly functions as a variable compliance cost driver rather than a static regulatory obligation. The cost implications are already live for brands operating in Oregon and Colorado. They arrive for California-covered brands in 2027.
The underlying calculation for EPR fees across all active U.S. states follows the same logic: for each material category, multiply the weight of covered packaging supplied into the state by the applicable rate per pound. Sum across categories to arrive at total fee exposure for that state. Repeat across all covered states in which the brand has a reporting obligation.
This structure means that two producers — both registered, both compliant, both selling into the same states — can have dramatically different fee exposures based entirely on packaging design. Size and revenue are secondary variables. The material mix is the primary driver.
A packaging format that generates elevated fees in one state rarely does so in isolation. As additional states operationalize fee systems, the same material architecture creates cumulative exposure across multiple reporting jurisdictions simultaneously. A format decision made for a single market becomes a multi-state cost position as program coverage expands.
Most compliance teams, when they first engage with EPR fee calculations, assume that weight is the dominant variable and that the path to lower fees runs through packaging reduction. Weight reduction does reduce fees, but it is not the highest-leverage variable for producers with established packaging formats. Packaging architecture is.
Consider a brand that uses flexible laminate stand-up pouches as its primary packaging format. The pouch may weigh less per unit than a glass jar, but the pouch falls into a high-rate material category — multilayer flexible packaging — with no established domestic recycling infrastructure. The glass jar falls into a lower-rate category with functional collection and processing infrastructure in most markets. On a rate-per-pound basis, the pouch may generate significantly higher fee exposure than the jar, even at lower weight.
This is not an edge case. Flexible packaging formats — pouches, sachets, films, laminates — are among the fastest-growing packaging categories in consumer goods, and they consistently land in the highest-rate fee categories across Oregon, Colorado, and California's developing rate structure. The commercial logic that drives format selection — barrier performance, shelf appeal, logistical efficiency, direct-to-consumer optimization — does not currently incorporate the EPR fee variable. That gap is a compounding cost problem as fee volumes grow and more states come online.
This is also why lightweighting alone does not reliably reduce EPR exposure over time. A lighter package in a structurally higher-fee material category can still generate greater total fee liability than a heavier package in a material category with mature recycling infrastructure. The lowest-cost packaging option at procurement may become the highest-cost packaging option under multi-state EPR fee systems.
Eco-modulation is a fee adjustment layer applied on top of base material-category rates. It is the mechanism by which EPR programs introduce performance incentives — rewarding packaging that performs better on recyclability criteria and surcharging packaging that performs worse.
Eco-modulation takes different forms in different states, but the underlying logic is consistent: base fee rates are set at the material category level, and eco-modulation factors adjust individual producers' fees up or down based on whether their specific packaging performs better or worse than the category average on defined metrics.
Oregon's program — the most operationally developed U.S. eco-modulation system — uses a bonus/surcharge structure layered onto base material rates. Recyclability assessment is conducted using Oregon DEQ's Recyclability Determination Framework, which evaluates whether packaging material types are actually collected, sorted, and recycled in sufficient volume across the state to meet defined thresholds. Packaging that meets the threshold earns a fee reduction. Packaging that falls below the framework thresholds may be subject to surcharge treatment or higher fee exposure depending on the applicable category and adjustment structure. The eco-modulation adjustment is independent of the base rate category — a producer can be in a lower base-rate category and still receive a surcharge if their specific packaging design fails the recyclability assessment for their market area.
EPR systems evaluate whether packaging is recyclable in practice within the state's actual collection and processing infrastructure — not whether the packaging carries a recyclability claim or can theoretically be recycled under limited conditions. The most consequential misconception in eco-modulation is that packaging marketed as recyclable — or carrying a recycling symbol — automatically earns a fee reduction. It does not. The eco-modulation frameworks in Oregon and Maine evaluate actual collection, sorting, and end-market performance, not recyclability claims or label designations.
Oregon's Recyclability Determination Framework assesses whether a packaging material is collected by a sufficient percentage of Oregon's curbside collection programs, whether it is sorted and directed to appropriate end markets, and whether those end markets have sufficient domestic processing capacity to handle the material. A material can carry a chasing-arrows symbol, be technically recyclable in laboratory conditions, and still fail Oregon's framework because collection infrastructure does not exist at the required scale in Oregon communities.
Flexible plastic films are the clearest example. Most flexible film packaging — LDPE bags, stretch wrap, certain pouches — is technically recyclable at designated retail drop-off locations. It is not recyclable at curbside in most Oregon communities at the scale Oregon's framework requires. The result: producers using flexible film packaging are assessed a recyclability surcharge, not a bonus, despite the presence of a recycling pathway. The pathway does not meet the threshold.
This creates a specific compliance risk for producers who have made packaging investments based on recyclability claims rather than recyclability infrastructure assessments. The investment may be real. The eco-modulation credit may not follow.
Key Distinction
Eco-modulation frameworks assess recycling infrastructure performance in the specific state — not recyclability potential as claimed on packaging. A material can be recyclable in principle and still generate a surcharge if its collection, sorting, and end-market performance fails the applicable threshold. Recyclability designations and eco-modulation credits are not the same thing.
The operational challenge with eco-modulation is not primarily a compliance problem. It is a cross-functional alignment problem — and it begins long before the compliance team receives any data.
Packaging design decisions — format selection, material specification, component engineering — are made by product, industrial design, and procurement. Those decisions are typically finalized before a product goes into production, often 12 to 24 months before the product reaches market. By the time a compliance or legal team encounters the EPR reporting obligation, the packaging is already specified, already sourced, and already in market. The cost structure has been designed in. The compliance team is reporting on decisions they had no role in making.
This structural disconnect plays out in two ways. First, brands that switch to flexible packaging formats for commercial reasons — barrier performance, direct-to-consumer optimization, sustainability positioning — often don't model the EPR fee implications of those format changes. A shift from glass to flexible laminate pouch that reduces logistics cost and carbon footprint may simultaneously increase EPR fee exposure by a factor of four or more across fee-active states. That trade-off calculation is not currently happening in most product and procurement workflows.
Second, the eco-modulation bonuses available in Oregon — and expected in other states — require documentation that packaging suppliers, not brands, typically hold. PCR content percentages, material composition certifications, recyclability assessments — these are supplier-side data points. Claiming eco-modulation credits requires brands to build supplier data collection processes that most have not formalized. By the time the first reporting cycle arrives, the opportunity to build those processes proactively has typically passed.
The Timing Problem
By the time compliance teams receive the packaging data needed for reporting, the financial consequences of the packaging architecture are already embedded in the product. The packaging is specified. The suppliers are contracted. The format decisions that determine EPR fee exposure were made by functions that did not have fee rates in front of them when those decisions were made.
EPR fee modeling is a procurement and product design input, not a compliance reporting output.
Given that eco-modulation frameworks are live in Oregon and Maine, developing in Colorado, and authorized for California's fee program beginning in 2027, the brands with the most defensible compliance position — and the lowest unnecessary fee exposure — are the ones building packaging-level data visibility before the next reporting cycle rather than after it.

The brands best positioned as EPR fee systems mature are not necessarily the ones with the most sustainable packaging. They are the ones whose compliance teams have visibility into the full material composition of their portfolio, whose procurement processes capture supplier-side data required to substantiate eco-modulation credits, and whose product teams receive EPR fee modeling as an input to format decisions rather than a report on decisions already made.
That is a cross-functional data and process problem — not a form-filing problem. The filing process itself is often less difficult than assembling the packaging and supplier data required to support it. The cost engineering behind it requires functions that have not historically coordinated on compliance outcomes to begin sharing data that most of them do not yet collect in a compatible format.
The brands that treat EPR as a static reporting obligation will likely discover the cost implications only after packaging decisions have already scaled across multiple states. In many cases, the packaging format has already scaled across national distribution before anyone models its multi-state EPR cost profile. By then, redesign cycles, supplier contracts, and packaging inventories are often already locked. The exposure is real — and the window to address it upstream narrows with each product launch and each new state that activates fees.
The Bottom Line
Eco-modulation does not reward brands for claiming their packaging is recyclable. It rewards — and penalizes — based on what the packaging actually does in the recycling system of the state where it is sold. That distinction has a dollar value. For brands with significant flexible packaging exposure across Oregon, Colorado, and California, that dollar value is already material.
