What HB 22-1355 requires from your brand
Colorado's producer responsibility program is administered by CDPHE. It creates mandatory registration, data reporting, and fee payment obligations for any producer selling covered products into the state. EPR Colorado, in one line: HB22-1355 (also written HB 22 1355) brings extended producer responsibility to packaging and paper products, run through Circular Action Alliance — the producer responsibility organization whose program plan CDPHE approved in December 2025 — with Colorado EPR fees, called producer responsibility dues, payable since January 2026.
Producer Registration
Register with a CDPHE-approved Producer Responsibility Organization or directly with the state. Registration enables your brand to legally sell covered products in Colorado.
Annual Reporting
Submit material data reports covering all covered packaging sold into Colorado. The 2026 reporting cycle has closed. Reports must meet CDPHE's data quality standards.
Annual PRO Fees
Fee rates are set by your PRO and assessed on covered material volume. Brands that design for recyclability may qualify for reduced eco-modulation rates.
Colorado EPR fees under HB22-1355
Colorado EPR fees — called producer responsibility dues — are paid to Circular Action Alliance, whose program plan CDPHE approved in December 2025. Dues have been payable since January 2026 and are owed every year after that, calculated on the covered materials you report. Producers of certain automotive and lubricant packaging may also owe dues to Interchange 360, Colorado's separately approved program.
